Special conditions for subscription to mobile services for private users with billing (postpaid) offered by IPKO Telecommunications LLC Article 1 - Contents of Special Conditions 1.1 These special conditions for subscription to mobile services for private users with contract (postpaid) (hereinafter the Special Conditions) govern the rights, obligations and conditions for use of mobile phone service for private users, provided by IPKO Telecommunications LLC (IPKO). 1.2 In addition to these specific conditions, manner and conditions for the provision of mobile phone services, will be governed by Law on Electronic Communications no. 04/L-109 and other regulations applicable to the provision of electronic telecommunications in Kosovo, approved by the Regulatory Authority of Electronic and Postal Communications (RAEPC); General Conditions of subscriptions to IPKO telecommunication services (hereinafter General Conditions), contracts for subscription to mobile services for private users with billing (postpaid), offers, annexes, IPKO price list, as well as other documents signed by the Subscriber and IPKO, which as a whole constitute the agreement between them. Article 2 Definitions 2.1 Agreement means the entire contractual relationship between the Subscriber and IPKO to use mobile telephone service with billing for private users. 2.2 Non-geographic numbers are telephone numbers that do not indicate the geographical location of the telephone number. 2.3 SIM (Subscriber Identity Module) card - contains the code that enables the identification of networks and users. SIM card offers protection to users via PIN (Personal identification number). When the code is entered three times unsuccessfully, card is temporarily blocked account. SIM cards can be unblocked by entering your PUK code (Personal Unblocking Code). 2.4 In addition to the definitions set forth above, the interpretation of the agreement in its entirety shall be governed by all definitions listed in the General Conditions. Article 3 - Provision of service 3.1 In order to access the mobile services for businesses, the subscriber is obliged to enter into a contract with IPKO. For the contract, he/she must submit necessary information to IPKO in accordance with the Rules for Registration of private users. 3.2 In order to use this service, subscriber will be provided with a SIM card, respectively a phone number. Service activation may take up to 2 working days after the moment of signing of the agreement between the subscriber and IPKO. 3.5 With the activation of the subscription the price of selected prepayment will be at the disposal of the subscriber in his account balance, which will be valid until the end of the month regardless of when the subscription is activated. Obligations of IPKO Article 4 Quality of service 4.1 IPKO will offer to the subscriber a high quality service, in good faith and in accordance with the technical possibilities and conditions agreed. 4.2 In accordance with the General Conditions, IPKO will not be liable for any interruption or weakening of the mobile phone service, or for any defect in the network, caused by natural disasters, or any circumstance beyond the control of IPKO, which cannot be predicted and prevented (force majeure). 4.3 Notifying the subscriber in advance, IPKO reserves the right to discontinue provision of service for reasons of maintenance, improvement, modernization, and optimization of the network. These outages can last for the duration of the performance of the works. 4.4 In any case, IPKO will not be liable for any indirect damage or loss of income caused to the subscriber. 4.5 No assurance or guarantee can be given about the availability, quality, operation, or maintenance of voice traffic or data in cases where subscribers communicate with individuals who use a different telecommunications operator. Article 5 Customer Care 5.1 In accordance with the General Conditions, IPKO will offer to subscribers telephone support for 24 hours during the week (24/7), at the following free official telephone numbers: +386 (0) and (0) Upon notification of the defect, if the same cannot be eliminated by telephone, at the latest within 24 hours of the reporting, IPKO will compensate the lost days. Obligations of the subscriber Article 6 - Regular use of service by subscribers 6.1 The subscriber is obliged to use mobile services with billing for the private user in full compliance with the agreement in question. 6.2 In accordance with Article 10 of these special conditions, the subscriber is obliged to pay the bills presented by IPKO in timely manner. Article 7 - Measures for misuse of service by the subscriber 7.1 Subscriber shall not misuse the service. If there is reasonable evidence that the subscriber has misused the service in any way, and if this action is evidenced by IPKO, depending on the severity of the misuse, IPKO has the right to take the following measures: To warn the subscriber to use the service in accordance with the Agreement; To automatically suspend or cancel the service provided by IPKO, without obligation for compensation to the subscriber and require compensation as a result of damages caused by misuse, made by the subscriber. 7.2 In the event that IPKO cancels the contract with the subscriber for reasons mentioned above, the latter is responsible to fulfill all remaining financial obligations to IPKO. Article 8 - Cooperation with law enforcement authorities 8.1 The subscriber is fully responsible for the content of information or data, which he or she transmits and transfers to a third party through the IPKO mobile network. 8.2 IPKO bears no responsibility for this content, and for the data received by the subscriber from third parties through IPKO network. 8.3 In accordance with the General Conditions and the applicable laws in Kosovo, IPKO will cooperate with law enforcement authorities related to claims that these authorities may have about the service in question used by subscribers. Article 9 - The price and payment 9.1 Prices of services are published in the IPKO price list. IPKO reserves the right to change these prices, by notifying the subscriber in advance, on IPKO website, 9.2 Depending on the chosen package, the subscriber will have a monthly spending limit, respectively, as follows: The first package (Monthly S) in the amount of (seventy euros), The second package (Monthly M) in the amount of (one hundred euros); Third Package (Monthly L) in the amount of (two hundred euros); month subscription package (Monthly S) in the amount of (one hundred and twenty euros) plus the phone HTC Desire 200 in the amount of 0.00, the total payment (one hundred and twenty euros); month subscription package (Monthly M) in the amount of (one hundred and eighty euros) plus the phone Samsung Galaxy S4 mini in the amount of (ninety-nine euro and ninety-five cents) total payment (two hundred and seventy-nine euro and ninety-five cents); month subscription package (Monthly L) in the amount of (three hundred euros), plus the phone IPHONE 5S in the amount of (three hundred and ninety-nine euro and ninety-five cents) total payment (six hundred and ninety-nine euro and ninety-five cents). 9.3 In cases where the subscriber prepays for any of the subscriptions defined in paragraph 9.2, in which case he gets the phone pursuant to the chosen package, but does not pay the monthly bill, then the service will be terminated by IPKO and prepayment will be lost. 9.4 In cases where the subscriber after prepayment wishes to terminate the service prior to expiry of the prepayment period, the money will not be reimbursed by IPKO and the client will lose the subscription. 9.5 In cases where the subscriber is prepaid for one of the packages specified in Article 9.2, and in the meantime would like to change the package, the subscriber is required to pay the total price of the second package he/she wants to take, in which case he/she will lose all the benefits of the first package which has been used until the activation of the second package. 9.6 After using all minutes / SMS / MB that are part of the respective packages, subscribers will incur extra costs, thus to the specified limit of the package. 9.7 Terms of Payment - The subscriber will accept the invoice (s) by IPKO from date 1 to 6 of the month, while subscribers have to pay the bill at the latest by the 10th of the same month. 9.8 If the Subscriber does not pay the debt for the service provided by IPKO for 2 months in a row, according to the packages defined in Article 9.2, then IPKO will have the right to discontinue service and also the number in possession. 9.9 If the subscriber does not meet the deadline for payment of the invoice (s), IPKO reserves the right to suspend the service in question. In case of suspension of service, the subscriber is obliged to pay the price of re-connecting the suspended service, based on prices specified in the contract, and IPKO offers and brochures In the event that after the suspension, the subscriber does not pay the bills, IPKO reserves the right to cancel the service and deactivate the number, and begin legal proceedings for compensation of debt of the subscriber to IPKO The subscriber can check his account at any time by calling the short number * 123 # The subscriber is obliged to provide IPKO with accurate information, namely and residential address, in order to receive invoices issued by IPKO The Subscriber will receive invoices for service provided by IPKO in three different forms: SMS invoice, PDF invoice, self-care portal Access to self-care portal system is done by following the steps below: The subscriber must first sign a contract for provision of service; The subscriber must send a request via USSD The subscriber will receive an SMS with the username and password The subscriber must create a personal account in the business portal (self-care portal) The user will receive an SMS token code whenever he/she will require connection to the business portal (self-care portal). In this portal the subscriber will have access to all invoices for previous months. Article 10 - Entry into force, duration and termination of the agreement between subscribers and IPKO 10.1 Agreement for mobile services for businesses will enter into force upon signature of the contract by the subscriber, and shall be entered into for a period of at least 1 (one) year, with possibility of extension for other years, under the same conditions IPKO and the subscriber reserve the right to terminate the agreement before the expiration of the mandatory contract, with prior written notice of one month In the event of termination of this contract by the subscriber prior to the expiration of the contracted period, the subscriber is obliged to compensate IPKO for the value of investment of this service, which is specified in the contract for the provision of mobile telephony services for businesses In any event of termination of this Agreement, either by the subscriber or by IPKO, the subscriber is required to pay all outstanding debts to IPKO, within the deadlines set by IPKO, otherwise, IPKO will initiate legal proceedings for compensation of damage that has been caused to IPKO by the actions of the subscriber. Article 11 - Transfer of rights and obligations 11.1 The subscriber has no right to transfer the rights and obligations arising from this agreement to third parties without prior written approval from IPKO IPKO reserves the right to transfer the rights and obligations arising from this agreement to the legal successor of IPKO.
